Shine Lawyers allege that Toyota Hilux, Fortuner and Prado vehicles in New Zealand manufactured from 1 April 2015 to 31 May 2018, fitted with a 1GD-FTV or 2GD-FTV diesel engine were not of acceptable quality, and that Toyota New Zealand engaged in misleading and deceptive conduct in marketing and selling vehicles with faulty Diesel Particulate Filter (DPF) Systems.

The effects of a faulty DPF include:

  • poor performance and fuel efficiency;

  • damage to the exhaust and engine;

How do class actions work?

When large companies or institutions do the wrong thing and people are harmed or suffer loss as a result, an individual can have little to no means of bringing a legal claim. Class actions are an important mechanism within New Zealand’s legal system that allow large groups of people to come together to pursue a claim collectively.

Also known as a representative proceeding, class actions involve filing one legal proceeding on behalf of a large group of people who have suffered the same kind of losses or have similar interests. When a class action is successful, the legal fees and costs to run the class action are deducted from the settlement amount that is approved by the Court.
