What does No Win, No Fee* mean

No Win, No Fee* is a cost arrangement we offer, so you can access legal representation for your case without paying legal fees upfront.

No Win, No Fee* lawyers, like us will only charge you their legal fees if:

  • We win your case

  • You receive compensation or damages for your injuries

How do No Win, No Fee* lawyers work?

No Win, No Fee* lawyers work by not charging you any upfront costs while we fight for justice on your behalf. To do this we have a No Win, No Fee* cost arrangement (explained below).

To put it simply, if your case is unsuccessful, you won’t need to pay for any legal fees related to work done by your solicitor from Shine Lawyers.

Our No Win No Fee* cost arrangement

No Win, No Fee* (or ‘No Win, No Pay’) means that if we win your case, our legal costs are deducted from the total settlement or compensation amount you receive. They’re based on the work done by our legal team on your case (as outlined in your costs agreement).

If your case is unsuccessful, you don’t need to pay our legal fees.

If your case is successful, your lawyer will deduct your legal fees and disbursements from the compensation you receive.

What is a Costs Agreement

A costs agreement is a formal agreement between us (as your lawyers) and you (our client), that outlines the legal costs relevant to your case. These legal costs may be fixed or estimated and may include:

  • Legal fees, which may be based on a scale of costs and/or the hourly rates charged by members of your legal team

  • Disbursements, which are expenses incurred by other service providers as part of your case (such as a report from a medical expert who assessed your injuries)

In your initial, obligation-free consultation with one of our team members, we’ll take you through the costs agreement in detail and explain how each legal cost is calculated.

What costs are included in legal costs?

Legal costs include legal fees and disbursements. Legal fees relate to the work done by the legal team members. Disbursements are additional expenses incurred to support your case (such as the cost of obtaining a medical expert's report to assess your injuries).

What other expenses may be required?

Most legal cases will require support from third parties. These are part of the ‘disbursements’ in your case. Examples of third-party disbursements might be fees charged by doctors, engineers and barristers. Courts also charge fees to lodge documents as part of your case. In most situations, disbursements are recovered (in whole or in part) if you win your case.

How will I pay for disbursements?

How you’ll pay for disbursements depends on the terms of your costs agreement, for example:

  • You may required to pay for total or part of the disbursements before your case settles. If you are unable to fund disbursements yourself, we can offer you some options through third-party financial services (or 'funders') that can assist with the payment of your disbursements if you're unable to.

  • If a funder is involved, they'll provide you with a finance facility to cover the cost of disbursements during your claim. We can discuss this in more detail with you and answer any questions you may have.

Does No Win, No Fee* affect how much compensation I can claim?

Having a No Win, No Fee* cost arrangement doesn’t impact the amount of compensation you can claim.

How much do No Win, No Fee lawyers take?

The amount that each No Win, No Fee lawyer takes, depends on the structure of the costs agreement by the law firm handling the claim. From the outset, during your initial, obligation-free consultation with us, one of our team members will take you through your costs agreement in detail and explain how each legal cost is calculated.
