Asbestos exposure and asbestos diseases
There is a common misconception that some forms of asbestos, such as white asbestos, are harmless. This is not true for all types of asbestos. All asbestos is dangerous and inhalation of asbestos dust and fibre may result in severe asbestos-related diseases.
Asbestos-related diseases refer to any illness caused by exposure to asbestos. When inhaled, asbestos fibres accumulate within the lungs and cause scarring and inflammation. Repeated exposure to asbestos increases one's risk of developing an asbestos-related disease. There are many types of asbestos-related diseases, the most common of which are outlined below.
Pleural plaques are areas of fibrous thickening on the lining of the lungs and typically arise 20 to 30 years after asbestos exposure. The plaques can calcify over time but generally do not cause long-term health problems
Asbestosis specifically refers to fibrosis (scarring) within the lung tissue caused by asbestos. Shortness of breath is the main symptom of asbestosis.
Asbestosis is associated with occupational exposure of high intensity and over prolonged periods of time. It is a progressive disease that worsens with time – although it is non-cancerous.
Mesothelioma is an aggressive form of cancer that mostly develops in the lining of the lungs. Mesothelioma is associated with modest levels of asbestos exposure and has no known cure.
Asbestos induced lung cancer is generally associated with occupational exposure of high intensity and for prolonged periods of time. In many cases it carries a very poor prognosis.
Smokers who have been exposed to asbestos are at far greater risk of developing lung cancer than those who do not smoke.

Common questions about Asbestos lawyers and compensation claims
The law relating to asbestos compensation differs between states and territories in Australia, but in most cases a diagnosable asbestos illness and the source of the asbestos exposure (i.e. employer or manufacturer of the asbestos products which you were exposed to) need to be proved.
If you have an asbestos-related disease you may be able to claim, even if:
- You’re no longer working at the place where you were exposed
- Your employer is no longer in business
- You were self-employed or a contractor
- You were employed by more than one organisation
- You suffered second-hand exposure (contact with someone who was exposed to asbestos)
- You are, or were, a smoker
You could also make a claim, even if the asbestos exposure:
- Was not work-related
- Occurred during home renovations
- Is unknown to you
- Happened more than 50 years ago, interstate or overseas
Shine Lawyers can help you understand your rights. We know you have enough problems without adding complicated legal processes into the mix, so we keep it all really simple and get you the outcome you need.
The amount of compensation you receive can vary depending on your circumstances. Once we know more about your situation we should be able to give you an accurate indication of what you could expect in compensation.
In most instances a monetary value is placed on the gap between your life path before the injury, and your life path since the injury. All compensation claims are different and it will depend on the facts of your personal circumstances.
In most cases compensation covers:
- Pain and suffering
- Payment for loss of life expectancy
- Medical expenses (past and future)
- Loss of earnings (past and future)
- Home help and nursing help
- Care and help provided by friends and family
- Drugs and medical treatment
In most cases the insurance company of the employer/person at fault will compensate you under their policy. Even if the employer no longer exists it’s still possible to claim compensation.
Shine Lawyers and our team of experts can help by finding the employer’s insurer and applying to the court to reinstate the company for the claim.
You can claim for your immediate and future illness as well as income loss you have now and will have in the future.
In most successful asbestos claims, compensation is made through the court under the process of common law.
In some states, if you were exposed to asbestos during your employment, it’s also possible to claim under the workers compensation scheme for that state.
If someone close to you has passed away from an asbestos-related disease, you may be able to claim compensation on behalf of their estate or as a dependent.
We can help you with this on a No Win No Fee basis so you don’t have to worry about upfront costs and can focus on getting yourself and your family back on track.
It’s possible to speed up an asbestos compensation claim to make sure it’s finalised in the sufferer’s lifetime.
In some cases the claim may be finalised in a few weeks or months, but this depends on your particular situation and the facts of your case.
