Shine is committed to protecting the personal information of our people and treating the information we collect in accordance with the Australian Privacy Principles within the Privacy Act 1988 (Cth) (Privacy Act AUS) and New Zealand Privacy Principles in accordance with the Privacy Act 1993 (NZ) (Privacy Act NZ).

We encourage you to read through this statement so that you are informed and comfortable with how we handle your personal information. This applies to all applicants to a role at Shine.

Nothing in this statement seeks to modify or limit any person’s rights or obligations under the legislation relevant to the country within which they are employed.

From time to time, we may update this privacy statement to account for changes in the ways that we collect, handle and process personal information in our business. In these circumstances, we will publish updates on our website.

Giving consent

By voluntarily providing us with your personal or other sensitive information, you consent to us using this information to:

  • assist you with your enquiry;

  • progress your job application at Shine; and

  • offer related services that may be relevant to you.

We require this information for the purpose of progressing your job application and potentially employing you. Without this information, we may be unable to employ you.

Personal information we collect and method of collection

As an applicant, Shine will collect personal information from you. Generally, Shine only uses or discloses personal information about you for the purposes for which it was collected. Shine retains this information to ensure any future communication with you is relevant.

This may include, but is not limited to, the following types of personal information:

  • Names, contact and address details;

  • Resume, referee reports, and salary history;

  • Qualification details and related documents;

  • Aptitude test results;

  • Criminal history checks;

  • Information in identification documents (e.g. passport, driver’s licence);

  • Information relating to diversity, equity, and inclusion (e.g. demographic characteristics)

  • Visa or work permit status; and

  • Professional membership, payment, and other details (where they may relate to your employment or team member benefits).

  • Professional Certificates (including practising certificates)

  • Further information will be required from you if you are appointed as a staff member such as Bank Account details and Superannuation and related details to facilitate payroll and any employment tax or employment insurance requirements.

When we collect your personal information, generally we collect it directly from you. Sometimes it may be necessary for us to collect your personal information from a third party, for example a former employer or a referee. If you provide us with someone else’s personal information (example, an emergency contact), you should only do so if you have their authority or consent to provide us with their personal information. If you provide a recruitment agency with your personal information, and this information is sent to Shine, you should only do so if this recruitment agency has your authority or consent to provide Shine with your personal information.

It may be necessary in some circumstances for Shine to collect sensitive information about you in order to fulfil our duty of care to team members and clients.

It is generally not practical to remain anonymous or to use a pseudonym when applying to Shine as your personal information is required in order for you to be employed with Shine.

Security

Shine stores your personal information in different ways, including in hard copy and electronic forms. The security of your personal information is important to Shine and we take reasonable measures to ensure that your personal information is stored safely.

Our people are required to respect the confidentiality of current, former and prospective team members, and the privacy of individuals.

Your personal information will not be released to any third party unless we are required to do so by law or where you authorise this release.

In some circumstances, it may not be possible to irretrievably destroy your information without compromising other data that we are entitled to or obligated by law to retain. In these circumstances, we will restrict access or take steps to ensure that your information cannot be used.

We use cookies for a range of purposes such as; helping you navigate between pages efficiently, remembering any preferences you have set, and ensuring that the online advertisements you see are more relevant to you. Cookies also allow us to analyse user behaviours and help us make informed decisions on how to improve your experience with our website.

Use and disclosure of information

We may disclose information about you to third parties or entities outside of Shine including where it is reasonably necessary for the purpose of resolving your job application or enquiry or where we are required to disclose your information by law.

We may disclose your information and (with your consent) collect your information from:

  • employers and former employers;

  • third parties when outsourcing services, such as data storage or technology support services.

We have contractual arrangements with our service providers which require them to protect your personal information in accordance with the Privacy Act, including that they only use it for the purpose for which it is disclosed.

Shine may disclose your personal information where it is required by law to do so.

Disclosure of personal information to overseas entities

There may be situations where we store personal information with vendors who have been contracted to provide customer support and technological solutions. If these situations apply, we will be required to disclose your personal information to recipients outside Australia. To the best of our knowledge at this time, any such recipients would likely be located in the United Kingdom, European Union, United States of America, Canada, or New Zealand.

Required by law

There are times when we will be required by law to disclose any personal information we have about you, such as in the instance of an investigation into bankruptcy, counter-terrorism, fraud, taxation or in response to a subpoena etc.

Your information

We take all reasonable steps to ensure that information we collect, use or disclose is accurate, complete, up-to-date and securely stored. We take steps to protect your personal information from misuse, loss, and unauthorised access.

Request a correction

You have the right to request access to or correct the personal information that we hold about you.

We will respond as soon as reasonably possible. In some circumstances, we are permitted to deny your request for access, or limit the access we provide.

Complaint policy

If you are dissatisfied with how we have managed information or if you believe that we have breached the APPs, you may make a written complaint to us.

We will respond as soon as reasonably possible. If your concerns have not been resolved by that time, you may refer the matter to the Office of the Australian Information Commissioner via their website on www.oaic.gov.au
