Injured at work? Here’s what to do next

If you get hurt while on the job, the repercussions for both your body and your bank account can be unexpected and severe.  However, you don’t have to struggle alone. You may be entitled to compensation for your losses if you can show that your injury was caused by your employee’s negligence.

Work-related injuries can be highly traumatic, and lodging a workers’ compensation claim will not be the first thing that comes to mind if you suffer harm at work. So here’s a step by step guide for what to do in the event of a work-related injury to protect your legal rights and get you back on your feet as soon as possible.

What to do if you are injured

  1. Determine if the injury is life threatening. If the answer is yes, call 000. Otherwise, consult your doctor as soon as possible. Be sure to keep all medical records.
  2. Notify your supervisor and your relevant Workplace Health and Safety Authority of the incident.
  3. Record all details of the incident, including photographs where possible. Make sure to include:
    1. Your name and the name of your employer;
    2. Your occupation and job title;
    3. Where the injury occurred;
    4. How the injury occurred;
    5. Names and contact details of any witnesses; and
    6. Time and date your supervisor was notified.
  4. Request information from your employee about returning to work:
    1. What are the requirements and can you meet them?
    2. What are your rights?
    3. What are the procedures for resolving any issues that may arise?
  5. If necessary, contact a legal expert and make a workers’ compensation claim.

What is workers’ compensation?

Workers’ Compensation is designed to support workers who have been injured on the job. If you are injured at work, you may be able to claim compensation to cover your wages, medical expenses and rehabilitation costs in addition to other types of benefits. In most cases, you have six months to lodge a workers’ compensation claim. However, this changes from state to state so it is best to seek legal advice as soon as possible after your accident to ensure your rights are protected.

Common injuries covered by the workers’ compensation scheme include:

  • Injuries suffered at work as a result of work or during work activities;
  • Diseases caused by work;
  • Diseases or pre-existing conditions made worse by work activities;
  • Injuries suffered while travelling for work; and
  • Injuries suffered while receiving medical treatment for a separate work injury.
