Shine has helped resolve a long-running dispute between a truck driver and a sheep farmer in Central Victoria.
In 2012, the truck driver was driving his car carrier to a local caryard, fully loaded with new vehicles. The truck dropped down into a large gully left by the removal of a livestock grid, resulting in hundreds of thousands of dollars’ worth of damage to the truck and its expensive cargo. The car carrier was off the road for 12 months for repair, causing a significant impost to the truck driver’s business.
The grid had been removed for cleaning by the sheep farmer who owned the adjoining property. The sheep farmer denied liability for the damage to the vehicles and for the economic loss suffered by the truck driver.
We began acting for the truck driver in 2013 and in 2014, secured a settlement with the sheep farmer’s insurers. The compensation our commercial ligitation lawyers obtained for our client in this commercial dispute covered the repairs to the vehicles and the significant loss of income he sustained while he was off the road.
