What is the Allergan Breast Implant Class Action about?

On 2 August 2019, Allergan recalled all un-implanted macro-textured breast implants and tissue expanders from the Australian market in response to:

  • A rare, but acknowledged risk of breast-implant associated anaplastic large cell lymphoma (BIA-ALCL), associated with Allergan implants;

  • Higher incidence of reported cases of BIA-ALCL both in Australia and internationally; and

  • Evidence from the US Regulator, the Food and Drug Administration (FDA) that women who received Allergan textured breast implants had a six times higher risk of developing BIA-ALCL than other manufacturers.

Shine Lawyers’ class action investigation aims to determine whether women who were implanted with Allergan-manufactured breast implants before the August 2019 recall, who have suffered serious complications or illness as a result of their implants, should be compensated.

Frequently Asked Questions

How do I know if I received Allergan Implants?

It should be on the implant card that was provided to you at the time of your surgery.

If you cannot locate your implant card, we recommend you contact your place of surgery and/or your implanting surgeon and request your operation report.

What is a class action?

When Governments, large companies or institutions do the wrong thing and people are harmed or suffer loss as a result, an individual can have little to no means of bringing a legal claim.

Class actions are an important mechanism within Australia’s legal system that allow large groups of people to come together to pursue a claim collectively.

For a class action to take place, there are three criteria that need to be met:

  1. There must be 7 or more people that have claims against the same defendant; and

  2. The claims relate to the same or similar circumstances; and

  3. The claim must relate to at least one common issue of law or fact.

How long do class actions take to resolve?

It can take up to several years for a class action to resolve. The time taken from case commencement through to resolution and settlement administration depends on the particular case, and the nature of the claim.
