Current group and class actions


Sometimes wrongdoing is committed and injury or financial loss is suffered by more than one person. In these circumstances it may be possible to conduct a claim collectively as a group or class action.   

Class and group actions allow individual claims to be aggregated into a single action against a Defendant. Advancing cases as one proceeding can increase the efficiency of the legal process and allow losses to be recovered more expeditiously and at less cost.

A group or class action may also encourage an individual to prosecute his or her rights where the amount of compensation recoverable is relatively small. Such an action ensures a wrongdoer who causes widespread harm which impacts minimally against particular individuals is brought to account for the losses sustained. Furthermore, in ‘limited fund’ cases, a class action ensures that all plaintiffs receive relief and the assets recovered may be divided equitably by the court between all the plaintiffs in a successful case.

Class actions have become a vehicle for social and economic reform. Many of the leading civil rights cases, for example, were commenced by class action. The class action is also used to protect individuals from injury and is widely utilised in mass tort cases, where numerous plaintiffs are injured at the hands of a single defendant.

The legislation behind class actions differs in each state and may involve Federal law. Multi-party actions invoke a complex legal process and therefore it is important that a class or group action is conducted by a law firm with the necessary resources and experience in this specialised area of practice.
